SUBJECT: PETITION TO HINDER THE MINING OPERATION IN LOBO BATANGAS



COME NOW, Petitioner, LOBONIANS IN ROME ITALY herein represented by CYNTHIA FACELO ILAGAN, Filipino of legal age, and presently residing at Via Pier Luigi Sagramoso 52, Rome Italy; 

 -and- 

Intervener, TASK FORCE - OFW INTERNATIONAL, a duly registered and active association before the AGENZIA DELLE ENTRATE, otherwise known as SECURITIES AND EXCHANGE COMMISSION-SEC (as identified in the Philippine Agency), with Registry No. Fiscal Code 97797760580; herein represented by FELIX MENDOZA LANDICHO, JR., Filipino, of legal age and presently residing at Via Bernardino Bernardini, 22 - 00156 Rome Italy, after having been duly sworn to, in accordance with law, do hereby submit the foregoing PETITION TO HINDER THE MINING OPERATION IN LOBO BATANGAS, and hereby manifest with strong opposition for the current situation of this matter, thus: 


I. STATEMENT OF FACTS 


The undersigned Petitioner and Intervener clearly state: 

a. That the people of Lobo presently migrants in Italy particularly in Rome explore their concern in the home town; 

b. That since they observe worsening situation about the said mining operation; 

c. That in reality this operation is not applicable to their small town; 

d. That base on their observation when we continue the mining operation it will bring disaster to the       entire area such as follows: 
 i. Destruction of environment and natural resources, that kill our tourism identity. 
ii. Rise up of air pollution. 
iii. Water contamination from chemical waste. 
iv. Continuous damage of infrastructure due to passage of heavy loaded trucks and machineries. 
v. Diminishing production of the fruits that gave our identity like “ATIS”, banana, coconut, tamarind, rice, corn and etc. 
vi. And many more that confer risk for our next generation. 

e. That the matter has not been given due course until this petition is filed and submitted to the Batangas Governor's Office through the Governor, Hon. Vilma Santos-Recto. 




 II. THE LEGAL BASIS OF THE PETITION 


The undersigned PETITIONER and INTERVENER have filed this petition base on the following: 

 1. They are legitimate Lobonians. 

 2. Thru peoples initiative, this petition has associated of more or less than hundreds of peoples signatures “in Rome only”. 

 3. As OFWs or mga Bagong Bayani, they're concern to their families in the home town which are    more affected. 

 4. They have investments like houses, farms, religious and sports concern like “tuklong”, basketball     court for the youth, and etc. 

  5. Upon retirement they will go back to their beloved barangays. 



III. DISCUSSIONS AND ARGUMENTS 

 1. The Sangguniang Bayan of Lobo give their permission to the mining Company without prior consultation to their constituents; Due to lack of transparency the Resolution 2015-26 come into force.               **copy of the resolution attached 

 2. Some of Barangay Officials are still silent regarding the issue; Can be called mysterious act and lack of sympathy for their people, because they did not give any single information since the   beginning. 

 3. This honorable officials apparently deceived the people of Lobo Batangas. They did against the conscience of patriotism and pro-environment. 



 IV. PETITION 


From the above discussion, It is thus crystal clear that the Sangguniang Bayan and some Barangay Officials have arrogated upon themselves judicial functions in excess of their mandate. Thus, they have acted “same as” violation. It is a grave abuse of discretion amounting for giving way of mining operation, falling squarely into the proper subject for the PETITION TO STOP THE MINING OPERATION IN LOBO BATANGAS, BY ABROGATING THE RESOLUTION 2015-26



 V. PRAYER 


Petitioners and Intervener would like to submit the following prayers: 

1. Granting the CONSIDERATION TO STOP THE MINING OPERATION IN LOBO BATANGAS; 

2. Granting the creation of an INDEPENDENT CONSULTATIVE BODY, equally represented by the elected representatives of affected barangays; 
      **not the barangay officials 

3. Granting other powers and authorities of the INDEPENDENT CONSULTATIVE BODY to achieve the ultimate purpose of this matter. 



VI. CONSIDERATION 

The Lobonians believed and consider that the good governor is the mother of the Province and the Lobo Town is one of her son in trouble. For this reason they are strongly ask for a justified consideration.
